Terms of Service

1. Eligibility

You must be at least 13 years of age to use Unforkd. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have obtained parental or guardian consent to use the Service.

2. Description of Service

Unforkd is a restaurant discovery application that helps groups decide where to eat through a collaborative voting mechanism. The Service allows users to create or join group sessions, browse restaurant options sourced from third-party data providers, and vote on preferences to find a match.

Unforkd does not require account creation or login. The Service is provided on an anonymous, session-based model.

3. Acceptable Use

You agree to use the Service only for its intended purpose and in compliance with all applicable laws. You agree not to:

• • Interfere with or disrupt the Service or its infrastructure
• • Attempt to gain unauthorized access to any part of the Service
• • Use the Service for any unlawful, fraudulent, or malicious purpose
• • Reverse engineer, decompile, or disassemble any part of the Service
• • Use automated scripts, bots, or scrapers to access the Service
• • Abuse, harass, or disrupt other users' sessions

We reserve the right to restrict or terminate access to the Service for any user who violates these Terms.

4. Intellectual Property

The Unforkd name, logo, branding, app design, source code, and all associated content are the exclusive property of Unforkd, LLC and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the Service without our prior written consent.

Restaurant data, images, ratings, and reviews displayed within the Service are provided by third-party data providers (including Yelp) and remain the property of their respective owners.

5. Third-Party Services and Content

Unforkd relies on third-party services to provide restaurant data, analytics, and push notifications. These include but are not limited to:

• • Yelp Fusion API — for restaurant information, ratings, and reviews
• • PostHog — for anonymous usage analytics
• • Amazon Web Services — for data storage and backend infrastructure

We do not control or guarantee the accuracy, completeness, or availability of third-party content. Restaurant information including hours, menus, prices, and ratings may not always be current. We encourage you to verify details directly with the restaurant.

Your use of third-party content accessed through the Service is subject to those third parties' terms and policies. Yelp content is subject to Yelp's Terms of Service.

6. Location Services

Unforkd requires access to your device's location to provide restaurant recommendations near you. By enabling location services, you consent to the collection and use of your location data as described in our Privacy Policy.

You may disable location access at any time through your device settings, but this will limit the Service's core functionality.

7. Push Notifications

Unforkd may send push notifications to inform you of session updates, such as when participants join or a match is found. You can opt out of push notifications at any time through your device settings.

8. Disclaimer of Warranties

We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not guarantee the accuracy or reliability of any restaurant information, ratings, or reviews displayed through the Service.

Unforkd is a decision-making tool only. We are not responsible for your dining experience, food quality, food safety, or any issues arising from visiting a restaurant discovered through the Service.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Unforkd, LLC, its members, officers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising out of or in connection with your use of or inability to use the Service.

In no event shall our total liability to you for all claims arising from or related to the Service exceed the amount you paid to us in the twelve (12) months preceding the claim, or $50, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless Unforkd, LLC, its members, officers, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service or violation of these Terms.

11. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall first be resolved through good-faith negotiation between the parties. If a resolution cannot be reached within thirty (30) days, either party may pursue binding arbitration administered in accordance with the rules of the American Arbitration Association.

You agree that any disputes will be resolved on an individual basis and not as part of a class, consolidated, or representative action.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict of law provisions.

13. Modifications to Terms

We reserve the right to update or modify these Terms at any time. Changes will be reflected with an updated “Last Updated” date at the top of this page. Your continued use of the Service after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and without prior notice. Since Unforkd does not use accounts, termination may include blocking specific devices or IP addresses from accessing the Service.

You may stop using the Service at any time by uninstalling the app or closing the website.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
